Fixed Recoverable Costs Delayed For Housing Cases.



The Ministry of Justice has announced that the introduction of Fixed Recoverable Costs for housing cases has been delayed until at least October 2025.

The MoJ added that the delay for housing cases would “allow for the impact of changes in the housing sector to become clearer over the two year period”.

The Social Housing Regulation Bill is one of the much anticipated changes which is awaited and which when implemented will give the Regulator of Social Housing stronger powers to deal with standards and to regularly inspect landlords on issues, such as health and safety and repairs within their properties.

Law Society president Lubna Shuja welcomed the reprieve but urged the government ‘to consider scrapping the implementation of Fixed Recoverable Costs in housing cases entirely, as the complexity and unique nature of housing cases makes them unsuitable for the application of Fixed Costs’.

There has been much criticism, and it has been argued that if lawyers are not properly paid for bringing successful cases against landlord then tenants and borrowers will not have access to justice.
