It may be only then that your client turns their mind to the adverse costs and disbursements risk. Sometimes a case may be complex or clearly a multi-track matter from day one.

As with all the ATE products we arrange, the aim is to provide clients with a cost effective After the Event Insurance policy with minimal administration for you, their solicitor.
You normally only need to tell us when you win, lose or are issuing proceedings. And you do it with just the click of an online button - or let us set up your case management system to do it for you automatically. So that’s it - there’s nothing else to report. You do not have to get permission from the insurer to incur any disbursement or to take any step.
This means you are free to concentrate on what you do best, handling files.
We keep a track of all claims made and can work out how long it is between receipt of a claim form and a cheque being sent out in payment by the insurer. The average is 7 days. If you find any ATE insurer who is quicker then let us know.
If the ATE Insurance Policy premium is no longer required, you can cancel the ATE Insurance Policy for various reasons without charge. Typical reasons are:
This means that there is no risk that you or your client will ever have to pay the ATE insurance premium unless it is required.
If your client fails to beat a Part 36 offer, your disbursements and all adverse costs are paid in full by the After the Event Insurance policy (instead of being deducted from your own costs). And there’s no need to liaise with us about making, rejecting or accepting a Part 36 offer – that’s a decision for you and your client.
