Addresses of non-molestation order applicants disclosed in data breach

It has been reported in the Legal Gazette today that the Ministry of Justice have announced that the confidential addresses of two people applying for non-molestation orders was disclosed by them to the respondents.

In the recent MOJ report it was revealed that these disclosures were just 2 of 17 personal data incidents reported to the Information Commissioner’s Office in the 2021-22 financial year.

One of the reported disclosures included an incident whereby 11 bags of confidential waste containing offender and staff information was stored in an unsecured location potentially affecting 120 people.

An MOJ spokesperson said: “We handle million pieces of sensitive data safely and securely every year. While errors and data breaches are extremely rare, we take them very seriously and have introduced extra training and safeguards to ensure data is handled correctly”. 

The ICO is the UK’s independent body which has been set up to uphold information rights and the UK GDPR introduces a duty on all organisations to report certain personal data breaches to the relevant supervisory authority with 72 hours of becoming aware of the breach.

If the breach is likely to result in a high risk of adversely affecting individuals’ rights and freedoms, those individuals must also be informed of any potential breach without delay.
