Whiplash Tariff Amendment Update: A step forward, but it is enough for claimants?

In an important update for those affected by road traffic accidents, the Minster of State for Justice, Sarah Sackman, has announced a long-overdue update to the Whiplash Regulations. The draft regulations, are set to be laid before parliament under affirmative procedure, aiming to bring fairer compensation to those suffering from whiplash injuries.


If approved by both Houses, the new regulations will increase the fixed compensation tariff for whiplash injuries lasting up to two years for accidents occurring on or after the 31st of May 2025. This adjustment follows the statutory review of the 2021 whiplash Injury Regulations, with recommendations made by the Lord Chancellor her report published on November 21st 2024.


What this means for Claimants


The updated tariff will see an increase in compensation of approximately 15%. This increase accounts for the impact of inflation up to 2027.  The 15% increase has seen mixed reactions from legal professions with some claiming that the increase may not go far enough to reflect the financial and personal impact of these injuries.


What happens next?


For those involved in road traffic accidents before 31st of May 2025, the original 2021 tariff will still apply. However, this amendment will determine the future of whiplash compensation moving forward.


While the government has taken a step forward, some argue it’s a missed opportunity to make a real difference.
